Terms of Service

These terms set out the responsibilities and conditions that apply when customers and authorised users use the Adaptra Reacch 319 platform.

1. Acceptance of these terms

By accessing or using Adaptra Reacch 319 (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you use the Service for a business or organisation, you confirm that you have authority to bind it to these terms.

2. The Service

The Service provides customer workspaces for campaign funnels, landing pages, lead capture and management, communications, reporting, downloadable materials and webinar or one-to-one appointment journeys. Features vary by plan and may include optional third-party integrations.

3. Accounts and authorised users

You must provide accurate account information, protect credentials, restrict access to authorised users and promptly notify us of suspected unauthorised use. You are responsible for activity under your account and for configuring suitable roles for team members.

4. Customer campaigns, leads and consent

You control your campaign content, form fields, communications and use of lead information. You are responsible for having a valid legal basis, providing required notices, collecting necessary consent, honouring opt-outs and complying with advertising, telemarketing, email, privacy, insurance and other laws that apply to your activities.

You must not upload or send unlawful, deceptive, discriminatory, infringing, malicious or unsolicited content, or use the Service to obtain sensitive information that is unnecessary for the stated campaign purpose.

5. Google Calendar and third-party services

Google Calendar integration is optional and requires an authorised user to grant access through Google OAuth. When connected, the Service may check availability and create, update or cancel Calendar events and Google Meet links as described in our Privacy Policy. You may disconnect the integration at any time.

Google, Meta, email providers, customer domains and other third-party services are governed by their own terms and may change, suspend or discontinue their features. We are not responsible for third-party outages, account approvals, policy decisions or changes outside our control.

6. Plans, credits and billing

Available features, email or other credits, usage limits and support levels depend on the selected plan. Unless otherwise agreed in writing, customer subscriptions are billed quarterly in advance from the account start or renewal date. Renewal reminders are informational; the customer remains responsible for timely payment.

Fees are non-refundable once a billing period begins except where required by law or expressly agreed. We may suspend paid features or the account for overdue amounts after reasonable notice. Credits have no cash value, are not transferable between unrelated accounts and may expire or reset according to the applicable plan.

7. Customer content and intellectual property

You retain ownership of content and data you submit. You grant us a limited licence to host, copy, process, display and transmit that material only as necessary to provide, secure and support the Service. You confirm that you have the rights and permissions needed for the content, images, videos, contact lists and branding you provide.

The Service, software, interface, templates and platform branding are owned by or licensed to Adaptra Reacch 319 and may not be copied, reverse engineered, resold or used to create a competing service except where law expressly permits.

8. Acceptable use

You must not attempt to bypass limits or security controls, access another customer’s data, interfere with the Service, distribute malware, scrape the platform, test vulnerabilities without written permission, misrepresent identity or affiliation, or use the Service in a manner that harms users or our reputation.

9. Availability and changes

We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation. Maintenance, security incidents, hosting conditions and third-party dependencies may affect availability. We may improve, replace or discontinue features, with reasonable notice where a change materially affects an active paid service.

10. No professional or performance guarantee

The Service is a technology and marketing workflow platform. It does not provide legal, financial, insurance or investment advice. Campaign results, lead volume, attendance, appointment completion, conversion or revenue are not guaranteed.

11. Suspension and termination

You may stop using the Service subject to your billing commitment. We may suspend or terminate access for material breach, unlawful activity, security risk, non-payment or misuse. On termination, access may cease and data may be retained or deleted according to our Privacy Policy, contractual obligations and applicable law.

12. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without implied warranties of merchantability, fitness for a particular purpose or non-infringement. We are not liable for indirect, incidental, special, consequential or punitive loss, lost profits, lost opportunities or loss caused by third-party services.

To the maximum extent permitted by law, our aggregate liability arising from the Service will not exceed the fees paid by the affected customer for the three months immediately preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot lawfully be excluded.

13. Indemnity

You agree to defend and indemnify us against third-party claims, losses and reasonable costs arising from your campaign content, communications, unlawful collection or use of personal information, breach of these terms, or violation of another person’s rights.

14. Governing law and disputes

These terms are governed by the laws of India. The courts having jurisdiction at the operator’s principal place of business in India will have jurisdiction, subject to any mandatory rights that applicable law gives a consumer.

15. Changes and contact
